On October 24, Jorge Contreras will present his work describing the narrative themes that emerged from the Myriad Genetics gene patenting case as part of the “IP in the Trees” speaker series at Lewis and Clark Law School in Portland. Contreras argues that the litigants and commenters on the controversial case adopted a set of six distinct narratives to explain its facts and to situate it within the broader social context, and that the courts adjudicating the case, including the Federal Circuit and U.S. Supreme Court, both adopted these narratives in their opinions and shaped their doctrinal analyses to conform with the narrative that they selected.
