On Friday, December 7, Clifford Rosky, Associate Professor of Law at the University of Utah S.J. Quinney College of Law, was interviewed by several local news programs about the U.S. Supreme Court’s decision to review two cases involving the constitutionality of laws that prohibit same-sex couples from marrying. The first case, Windsor v. United States, asks whether a federal law known as the Defense of Marriage Act is constitutional. The second case, Hollingsworth v. Perry, asks the same question about a California law known as Proposition 8. Rosky explains that the Supreme Court was expected to review the Windsor case, because it involves the constitutionality of a federal law. But Rosky and others were surprised by the Court’s decision to review the Hollingsworth case, which potentially involves the constitutionality of 41 state laws that prohibit same-sex couples from marrying.
