Professor Nancy McLaughlin, whose research focuses on the laws governing charitable gifts, is serving as reporter for the Uniform Law Commission (ULC)’s Study Committee on Harmonization of the Law Governing Restricted Charitable Gifts. The committee will study the need for and feasibility of a law to govern restrictions on all charitable gifts, regardless of the gift’s form, the recipient’s organization, or label assigned to the gift under state law.
The ULC is a nonprofit association comprised of state commissions on uniform laws from each state, Washington, D.C., Puerto Rico, and the U.S. Virgin Islands. Commissioners gather to study and review state laws to determine which areas should be uniform and draft and propose specific statutes in areas of law where uniformity between states is desirable.
In 2023, McLaughlin published an article in the Utah Law Review about changes in laws governing donor-imposed restrictions on charitable gifts primarily as states adopt the Uniform Trust Code and Uniform Prudent Management of Institutional Funds Act.
