Professor Jorge Conteras and Associate Professor Daniel AaronProfessor Jorge ContrerasAssociate Professor Daniel Aaron and more than a dozen IP, health law and bioethics scholars, including University of Utah Professor Kimberly Kaphingst, filed an amicus brief in the 23andMe bankruptcy case, In re: 23andMe Holding Co., et al., on June 11.

The brief argues that data contributed by 12 million 23andMe customers who consented to data use for biomedical research should not be hoarded within a single-buyer company for its exclusive internal use. Instead, the Supreme Court should require the buyer to continue to make this consented data available to academic researchers on a royalty-free basis and offer to license it broadly on fair, reasonable and nondiscriminatory terms to commercial researchers in the interest of greater scientific advancement, medical discovery and public health.
