Criminalizing Enablers and Bystanders: Legal Accountability and Professional Responsibility

EVENT DESCRIPTION:

This CLE explores the evolving legal landscape surrounding the criminal and civil liability of individuals who enable or fail to act in the face of misconduct. Through case law, statutes, and real-world scenarios, the program examines when bystanders, advisors, and professionals may face legal accountability, as well as the ethical obligations imposed under rules of professional responsibility. Attendees will gain practical guidance on identifying risk, navigating gray areas, and maintaining compliance in high-stakes situations.

 

PRESENTERS:

Professor Amos GuioraAmos N. Guiora holds an A.B. from Kenyon College, a J.D. from Case Western Reserve University School of Law, and a Ph.D. from Leiden University. He is a Professor (Lecturer) at the University of Utah S.J. Quinney College of Law, where he directs the Bystander Initiative. Professor Guiora is a Distinguished Fellow and Counselor at the International Center for Conflict Resolution at the University of Pittsburgh, a non-resident fellow at George Washington University’s Program on Extremism, and a Distinguished Fellow at Chicago-Kent College of Law’s Consortium on the Study of the Holocaust and the Law. His scholarship focuses on bystanders and enablers, reflected in several books including The Crime of Complicity, Armies of Enablers, and The Complicity of Silence, with a forthcoming work, Enablers. He has also authored numerous law review articles, is frequently interviewed by media, and has testified in the U.S. and abroad advocating for the criminalization of bystanders and enablers. In recognition of his work, he received the University of Utah’s Bennion Center Distinguished Faculty Service Award in 2023 and was named Outstanding Professor by the S.J. Quinney College of Law’s 2024 graduating class.
