SUMMARY:Wallace Stegner Center 24th Annual Symposium - Recreation Challenges on Public Lands
DESCRIPTION: \nS.J. Quinney College of Law Moot Courtroom (Level 6)\nIn recent years\, outdoor recreation has become a primary use of the public lands\, creating myriad conflicts\, challenges\, and opportunities. A substantial portion of the public domain is managed for recreation in the form of national parks\, national monuments\, wilderness areas\, and the like\, drawing millions of visitors annually. Outdoor recreation is now big business\, constituting two percent of U.S. gross domestic product (GDP)\, which is more than agriculture\, mining\, or oil and gas development individually contribute to the nation’s GDP. Conflicts have grown more intense between recreation users (e.g. hikers\, mountain bikers\, and ATVers)\, and new environmental problems have surfaced in the form of soil erosion\, water pollution\, and wildlife displacement\, while the land management agencies lack the necessary resources to effectively address these problems. The symposium will first examine the economic\, social\, and legal framework for recreation on the public lands\, and then extract lessons from specific recreation problems in the Wasatch Mountains and the Moab area. A symposium highlight will be “A Conversation with the Secretary” between Sally Jewell\, former Secretary of the Interior\, and Robert Keiter of the University of Utah S. J. Quinney College of Law. DESCRIPTION:A Wallace Stegner Center Green Bag lecture \n 12:15-1:15 p.m.\, S.J. Quinney College of Law\, Level 6\nIn his presentation on “Bridging the Divide\,” Senator Jeff Bingaman will discuss the obstacles that make it difficult to find common ground on policy disputes in Washington. He will discuss the tactics that undermine the proper functioning of the federal government\, including shutdowns\, threats to default on the national debt\, and Senate refusal to consider Presidential nominations. \n\nJeff Bingaman\, United States Senator\, New Mexico\, 1983-2013\nJeff Bingaman was born on October 3\, 1943. He grew up in the southwestern New Mexico community of Silver City. His father was a chemistry professor and chair of the science department of Western New Mexico University. His mother taught in the public schools. After graduating from Western (now Silver) High School in 1961\, Jeff attended Harvard College and earned a Bachelor of Arts degree in government in 1965. He then entered Stanford Law School we he met\, and later married\, fellow law student Anne Kovacovich. Upon earning his law degree from Stanford in 1968\, Jeff and Anne returned to New Mexico. They have one son\, John. After law school Jeff spent one year as an assistant attorney general and eight years in private law practice in Santa Fe. Jeff was elected Attorney General of New Mexico in 1978 and served four years in that position. In 1982 he was elected to the United States Senate. He was re-elected to a fifth term in the Senate in 2006. At the end of that term he chose not to seek re-election and completed his service in the Senate on January 3\, 2013.  At the time of his retirement from the Senate he was Chairman of the Energy and Natural Resources Committee. He also served on the Finance Committee\, the Health\, Education\, Labor and Pensions Committee and the Joint Economic Committee. In April of 2013 he began a year as a Distinguished Fellow with the Steyer-Tyalor Center for Energy Policy and Finance and Stanford Law School. In 2015 he taught a seminar the function of Congress\, in the Honors College at the University of New Mexico.  Jeff and his wife\, Anne\, reside in Santa Fe\, New Mexico. \n1 hour of CLE (pending). SUMMARY:Guilty Until Proven Innocent: The Kristine Bunch Story
DESCRIPTION:Registration requested » \n12:15-1:15 p.m.\, S.J. Quinney College of Law\, Room 4603\nKristine Bunch spent more than 17 years behind bars after she was arrested and charged with setting a fire that claimed the life of her three-year-old son\, Anthony\, Although a defense expert testified that the fire was accidental\, two experts for the prosecution testified that an accelerant was used and therefore the fire was arson. Jurors believed the prosecution witnesses and found Kristine\, then 22 and pregnant\, guilty of murder and arson. She was sentenced to concurrent prison terms of 60 years for murder and 50 years for arson. Eleven years later\, the Indiana Court of Appeals reversed the conviction\, holding that Kristine was entitled to a new trial both because the evolving fire science met the legal criteria for new evidence and because undisclosed ATF evidence directly contradicted the prosecution expert testimony. The Indiana Supreme Court then unanimously affirmed the Court of Appeals decision. Kristine\, who had earned undergraduate degrees in English and anthropology from Ball State University in prison\, was released on her own recognizance — 17 years\, one month\, and 16 days after her wrongful arrest. She walked out of the Decatur County Jail into the arms of her family\, who had steadfastly supported her throughout her ordeal. Eight days before Christmas 2012\, the prosecution dropped all of the charges. \nKristine is now the Executive Director of JustIS 4 JustUS\, a non-profit organization dedicated to building community connections for every exoneree as they are released\, changing their lives for the better\, and supporting exonerees as they transition back into society. \nAt this lunch event\, Kristine will tell her story of wrongful conviction and incarceration and talk about her important work to help other exonerees. \nLunch provided. \nPresented by:\n \n  \n  \n  \nThe Rocky Mountain Innocence Center and The Innocence Clinic at the University of Utah College S.J. Quinney College of Law\nWendy Fisher\, Executive Director\, Utah Open Lands\n\nSession Descriptions\nLessons to be Learned from Federal Tax Law Cases\nThis session will cover a variety of important and vexing § 170(h) qualification issues\, such as extinguishment\, division of proceeds upon extinguishment (post-donation improvements and mortgage subordination)\, automatic approval and constructive denial clauses\, amendments\, identifying building areas or reserving rights to locate or move building areas\, the “once encumbered always encumbered” rule\, and satisfying the conservation purposes test. Topics are subject to change as new court decisions are issued. \nSubstantiation & Valuation Regulations and Related Case Law\nThis session will provide a comprehensive overview of the Final Treasury Regulations addressing substantiation and valuation (published in July 2018) as they relate to conservation easement donations. Topics to be covered include who is a “qualified appraiser\,” what is a “qualified appraisal\,” how to properly complete the IRS Form 8283 (appraisal summary) and Supplemental Statement\, and the contemporaneous written acknowledgment requirement. This session also will address specific conservation easement valuation rules (e.g.\, the enhancement and “larger parcel” rules). Relevant case law will be addressed. \nSyndicated Donation Transactions\nIn Notice 2017-10\, the IRS announced that certain syndicated conservation easement transactions are “listed” (tax avoidance) transactions that require both investors and material advisors to make disclosures to the IRS. In September 2018\, the IRS made these transactions the subject of one of its new “compliance campaigns.” And in December 2018\, the Department of Justice filed suit to shut down certain promoters of such transactions in Georgia. This session will address the latest IRS and DOJ efforts to curb abuses in the syndication context. \nSpeaker Bios\nKarin Gross is Special Counsel in the IRS Office of Chief Counsel in Washington D.C. She has been involved in much of the litigation and other IRS developments regarding interpretation and enforcement of the § 170(h) deduction for conservation easements donations. She lectures widely in a variety of venues on these issues. \nStephen J. Small is a tax attorney at his own firm\, the Law Office of Stephen J. Small\, Esq.\, P.C.\, in Newton\, Massachusetts. Before going into private practice\, Mr. Small was an attorney-advisor in the IRS Office of Chief Counsel in Washington\, D.C.\, where he wrote the federal income tax regulations on conservation easements. Mr. Small advises business and individual landowners and is recognized as the nation’s leading authority on private land protection options. He has worked directly on matters that have resulted in the protection of more than 1.5 million acres around the country. Mr. Small has given more than 400 speeches\, seminars\, and workshops around the country on tax planning for landowners\, succession planning for family lands\, and tax incentives for land conservation. He is a member of the Massachusetts and District of Columbia Bars. \nMark Weston is the Director of Colorado’s Division of Conservation\, the agency that administers the state’s conservation easement tax credit program. Prior to joining state government in 2016\, he practiced 30 years as an independent real estate appraiser\, with special interest in valuation of conservation easements encumbering private land. Mr. Weston assisted in development of and was an instructor of the five-day conservation easement valuation seminar developed by the American Society of Farm Managers and Rural Appraisers and the Appraisal Institute\, and is an AQB Certified USPAP Instructor. He co-authored the Land Trust Alliance’s Tax Benefits & Appraisals of Conservation Projects (2007)\, is a contributing author of the Water Rights Handbook for Colorado Conservation Professionals (Colorado Water Trust\, 2011) and Appraising Easements: Guidelines for Valuation of Land Conservation and Historic Preservation Easements (Land Trust Alliance & National Trust for Historic Preservation\, 3rd ed.\, 1999). \nNancy A. McLaughlin is the Robert W. Swenson Professor of Law at University of Utah S.J. Quinney College of Law. She is a Fellow and serves on the Board of Regents of the American College of Trust and Estate Counsel. She also is a member of the American Law Institute. She recently served as Reporter for the Uniform Law Commission’s Uniform Conservation Easement Act Study Committee. She is a member of the ABA’s Real Property\, Trust\, and Estate Law Section’s Conservation Easement Task Force. Her research focuses on conservation easements\, tax incentives\, and nonprofit governance issues and she writes and lectures extensively on these issues. She is a member of the Board of Directors of Utah Open Lands (a state-wide land trust)\, the Habitat Protection Advisory Committee of the Humane Society’s Wildlife Land Trust\, and the Lands Protection Committee of Vital Ground (a land trust that works to protect grizzly bear habitat). She consults with land trusts\, landowners\, government entities\, federal and state regulators\, and others regarding conservation easements and nonprofit governance issues. She has more than 28 years of experience with conservation easements and land trusts\, having joined with the original Board of Directors in founding UOL in 1990 and served as its Executive Director since 1993. Ms. Fisher and UOL have been recognized as leaders in conservation efforts in Utah and have been awarded many distinguished honors. For example\, in 2010\, UOL was awarded Utah State University’s Botanical Center’s Environmental Stewardship Award\, and in 2016\, Ms. Fisher was named Park City Rotary’s Professional Citizen of the Year in recognition of UOL’s successful campaign to save the cherished 1\,350-acre parcel known as Bonanza Flat. Ms. Fisher also has served on various state legislative task forces addressing agricultural\, trail\, and open space preservation issues\, and in 2018 she chaired a subcommittee of the Utah Legislature’s Executive Water Task Force. She also gave the opening remarks at Columbia Law School’s 2014 Conservation Easement Conference\, co-sponsored by the National Association of Attorneys General Program and the National Association of State Charity Officials. Quinney College of Law\, is currently an assistant U.S. Attorney at the U.S. Attorney’s Office in Salt Lake City. She is assigned to the office’s violent crime section\, handling some of the most serious crime cases in the state. She is working on two of the office’s special initiatives: Project Safe Neighborhood and Project Safe Childhood. Under Project Safe Neighborhood\, Ortega works with local\, state\, and federal law enforcement and prosecutes firearms offenses\, drug trafficking\, and violent crime in Indian County. Under Project Safe Childhood\, she works with local\, state\, and federal law enforcement and prosecutes sexual exploitation of minors offenses that include the possession\, distribution\, and production of child pornography. \nOrtega launched her career as a prosecutor at the Salt Lake County District Attorney’s Office in 2002 where she was a prosecutor in both the adult and juvenile justice system. She also worked from 2010 to 2018 as a deputy district attorney at the Davis County Attorney’s Office\, where she specialized in special victim cases that include sexual assault\, child abuse\, and domestic violence. \nOrtega has a rich history of service to the University of Utah\, where she served on the main campus Board of Trustees from 2013 to 2017 and represented the trustees on the KUER advisory board and the audit committee.
